Is the Earthshatterer a passive skill or does a piece of equipment have to give you that skill?

Earthshatter is a Special MainHand Skill of Hammers for Warrior Class…

Any class can use this skill if they used the Crystal Stone “Amber” to any Mainhand Weapon and managed to find the skill in the selection interface.

Equipping a gear with a Set affix of “Terrashaper” will grant you chance to cast Earthshatter on every attack.

Also, there’s one Legendary affix (Earthshatter Proc), that has a chance to cast Earthshatter on attack.

Additional on the Terrashaper set. It also procs Earthshatter when your char gets hit.
So It’s on hit and on attack for earthshatter proc.

7.5% Chance per rank of Terrashaper.
